What MEES Means for London Landlords

MEES regulations have been in force since 2018 for new tenancies and 2020 for all tenancies. The key rules:

  • You cannot grant a new tenancy on a property rated F or G
  • You cannot continue an existing tenancy on a property rated F or G
  • Penalties of up to £5,000 per property, plus publication of the breach
  • Minimum standard: EPC band E or above
  • Cost cap: you are only required to spend up to £3,500 (inc VAT) on improvements

Looking ahead — the government has confirmed its intention to raise the minimum to EPC C (or equivalent) by 2030. This is not yet law, but London landlords with D- and E-rated properties should start planning now.

MEES Exemptions — Do You Qualify?

If you cannot reach EPC rating E even after carrying out all relevant energy efficiency improvements, you may qualify for an exemption. Valid exemptions include:

  • All relevant improvements made — the property still cannot reach E (valid 5 years)
  • Recently became a landlord — a temporary 6-month exemption
  • High cost — the property cannot reach E within the £3,500 cost cap (valid 5 years)
  • Third-party consent refused — tenant, freeholder or planning authority refuses permission (valid 5 years)

Wall-insulation unsuitability and property-devaluation exemptions also exist (each valid 5 years). Note: listed buildings are not automatically exempt — it depends on whether compliance would unacceptably alter the building. All exemptions must be registered on the public PRS Exemptions Register. EPC C by 2030 — What Is Proposed (Not Yet Law)

Following the government’s 2025 consultation response, privately rented homes are expected to need EPC C (or equivalent, under reformed EPC metrics) with compliance proposed from 1 October 2030, alongside a higher £10,000 cost cap. These changes are proposed — not yet law — but for London landlords they mean:

  • Properties currently rated D or E will need improvement works
  • Planning now avoids rushed, expensive last-minute upgrades

What is the minimum EPC rating required to rent a property in London?
